Terms of Use & Content Policy

By accessing or using The CyberFoundry Project software, tools, websites, repositories, and related services (collectively, the "Services"), you agree to be bound by these Terms of Use and Content Policy ("Terms"). If you do not agree to these Terms, you may not use the Services.

1. Eligibility and Account Responsibility

  • You must have the legal capacity to enter into these Terms under the laws of your jurisdiction.
  • If accounts or API keys are used, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
  • You must promptly notify us of any unauthorized use or security incident involving your account or the Services.

2. Use of the Services

Subject to these Terms and applicable open source or proprietary licenses, CyberFoundry grants you a limited, revocable right to access and use the Services for lawful purposes. Additional license terms may apply to specific components (e.g., open source libraries); in case of conflict, those component licenses control your use of that component.

You agree not to:

  • Use the Services in violation of any applicable law or regulation.
  • Interfere with or disrupt the integrity, performance, or security of the Services or underlying infrastructure.
  • Attempt to gain unauthorized access to any systems, accounts, or data.
  • Reverse engineer, decompile, or attempt to extract source code from proprietary portions of the Services except as allowed by applicable law or license.

3. Acceptable Use and Prohibited Content

You may not use the Services to store, process, generate, or transmit any content that:

  • Is unlawful, infringing, defamatory, harassing, threatening, hateful, discriminatory, or invasive of privacy.
  • Contains or promotes malware, ransomware, spyware, or other malicious code.
  • Seeks to exploit or harm minors or vulnerable individuals.
  • Infringes any intellectual property, privacy, publicity, or other rights of any person or entity.
  • Violates export control, sanctions, or other regulatory restrictions.

You also agree not to:

  • Abuse rate limits, attempt resource exhaustion, or perform denial-of-service attacks.
  • Use the Services to train or operate systems whose primary purpose is to bypass or subvert security, copyright, or safety protections.
  • Misrepresent your affiliation with any person or organization, including falsely implying endorsement by CyberFoundry.

We reserve the right (but do not assume an obligation) to review, block, or remove content, and to suspend or terminate access where we reasonably believe these Terms or applicable laws are violated.

4. User Content and License

"User Content" means code, data, text, files, comments, configurations, or other material that you submit, upload, or otherwise make available through the Services.

By submitting User Content, you represent and warrant that:

  • You have the necessary rights and permissions to use and share the User Content.
  • Your User Content does not violate these Terms or any third-party rights.

Unless otherwise agreed in writing, you retain ownership of your User Content. To operate and improve the Services, you grant CyberFoundry a non-exclusive, worldwide, royalty-free license to host, store, process, transmit, display, and perform your User Content solely for:

  • Providing and maintaining the Services.
  • Debugging, security monitoring, and abuse prevention.
  • Aggregated and de-identified analytics and product improvement.

We will not sell your User Content and will handle personal data in accordance with our Privacy Policy.

5. Open Source and Third-Party Components

The Services may include or interoperate with open source software and third-party services subject to separate licenses and terms. You agree to comply with the terms of any such third-party licenses when using those components.

  • Open source licenses applicable to specific components will be made available in the project repository or documentation.
  • Use of third-party services (e.g., hosting, analytics, CI/CD, or Git platforms) is governed by those providers' terms and policies, which you must review separately.

6. Intellectual Property

Except for User Content and third-party components, CyberFoundry and its contributors retain all rights, title, and interest in and to the Services, including all associated intellectual property rights, trade names, logos, and branding.

  • You may not remove, obscure, or alter any copyright, trademark, or other proprietary notices on or within the Services.
  • Any feedback, suggestions, or improvement ideas you provide may be used by CyberFoundry without obligation to you, and you grant us a perpetual, irrevocable, royalty-free license to use such feedback for any lawful purpose.

7. No Warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any defects will be corrected. You are responsible for backing up your own data and configurations.

8. Limitation of Liability

To the fullest extent permitted by law, CyberFoundry and its contributors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services, even if advised of the possibility of such damages.

In jurisdictions where limitations of liability are restricted, our total aggregate liability arising out of or relating to the Services will not exceed the greater of:

  • The amount you paid (if any) for access to the specific portion of the Services giving rise to the claim during the 3 months preceding the event, or
  • One hundred (100) US dollars.

9. Indemnification

You agree to indemnify, defend, and hold harmless CyberFoundry and its contributors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Services.
  • Your User Content.
  • Your violation of these Terms or applicable law.
  • Your infringement or alleged infringement of any third-party rights.

10. Suspension and Termination

We may suspend or terminate your access to the Services, in whole or in part, at any time if we reasonably believe that:

  • You have violated these Terms or any applicable law.
  • Your use poses a security risk, operational burden, or potential harm to other users or third parties.
  • We are required to do so by law or by a third-party provider.

Upon termination, your right to use the Services will cease, but relevant license terms for open source components and surviving provisions of these Terms (including disclaimers, limitations of liability, and indemnities) will continue to apply.

11. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Services, applicable laws, or operational practices. When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice (such as via the project repository, website, or email).

Your continued use of the Services after updated Terms become effective constitutes your acceptance of the changes.

12. Governing Law and Dispute Resolution

Unless otherwise required by applicable law, these Terms are governed by the laws of the jurisdiction indicated in the project documentation or repository (without regard to conflict of laws principles).

Any disputes arising out of or relating to these Terms or the Services will be resolved:

  • First, through good-faith negotiation between you and CyberFoundry.
  • If not resolved, through a mutually agreed alternative dispute resolution process (such as mediation or arbitration), unless local laws require court jurisdiction.

14. Sponsorships, Donations, and Payments

14.1 Non-Refundable Nature of Contributions

Project sponsorships, donations, and other voluntary financial contributions made to The CyberFoundry Project (collectively, "Contributions") are typically non-refundable. By making a Contribution, you acknowledge and agree that you are not entitled to a refund or chargeback except as expressly required by applicable law or expressly agreed by CyberFoundry in writing on a case-by-case basis.

14.2 Case-by-Case Evaluation

Notwithstanding the general non-refundable nature of Contributions, CyberFoundry may, in its sole discretion, review and evaluate individual refund requests on a case-by-case basis, taking into account factors such as evident error (e.g., duplicate transaction), fraud, or legal compliance obligations. Nothing in this section obligates CyberFoundry to grant a refund, waiver, or credit in any particular situation, and any accommodation provided will not create a binding precedent for future cases.

14.3 No Equity, Control, or Ownership

Unless explicitly stated in a separate written agreement signed by CyberFoundry, Contributions do not grant you any equity, ownership interest, governance rights, or control over the project or its assets. Contributions are not loans, investments, or securities, and you should not rely on any expectation of financial return, revenue sharing, or profit participation.

14.4 Tax and Regulatory Matters

You are solely responsible for determining the tax treatment and consequences of any Contribution under the laws of your jurisdiction, including whether any deduction, reporting, or other obligation applies. CyberFoundry does not provide tax, legal, or financial advice regarding Contributions and makes no representation that any Contribution is tax-deductible or qualifies for any specific treatment.

14.5 No Reliance; Entire Understanding

You acknowledge that you are not relying on, and have not relied on, any representation, promise, or statement not expressly set out in these Terms regarding the use of Contributions, any specific project roadmap, feature delivery, service level, or long-term availability of the Services. Any descriptions of potential future functionality, roadmap items, or use of funds are aspirational only and do not create binding obligations or warranties.
